HubSign Terms of Service

Welcome to HubSign LLC (“HubSign,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website, services, and electronic signature platform. By using HubSign, you agree to these Terms. If you do not agree, please do not use our services.

1. Who Can Use HubSign

You must:

  • Be at least 18 years old
  • Have the legal capacity to enter into contracts

By using HubSign, you confirm you meet these requirements.

2. Your HubSign Account

  • HubSign offers a free plan allowing up to 5 documents per month.
  • Paid plans start at $5/month per user.
  • Free trials for paid plans may be available.
  • Fees are non-refundable except where required by law.
  • You can cancel your paid plan anytime, effective at the end of your billing period.

3. Free Trial and Paid Plans

We use your information to:

  • Provide and improve HubSign’s services
  • Process transactions and billing
  • Respond to customer support requests
  • Send service updates and security notifications
  • Analyze and improve website performance
  • Comply with legal obligations

We do not sell your personal information.

4. Your Content and Documents

When you upload documents or data to HubSign (“Your Content”), you:

  • Grant HubSign the right to store, process, and transmit Your Content as needed to
    provide our services
  • Retain full ownership of Your Content
  • Represent that you have all rights necessary to use and share Your Content

We do not claim ownership of your documents or data.

5. Electronic Signatures and Legality

HubSign’s electronic signatures comply with laws like:

  • The U.S. ESIGN Act
  • The Uniform Electronic Transactions Act (UETA)
  • The EU eIDAS Regulation

However, it is your responsibility to ensure that electronic signatures are valid for your specific documents, industries, and jurisdictions.

6. Acceptable Use

You agree not to:

  • Use HubSign for illegal purposes
  • Upload viruses, malware, or harmful code
  • Attempt to access other users’ accounts or data
  • nterfere with HubSign’s operations or security

We may suspend or terminate your account if you violate these Terms.

7. Integrations with Third-Party Services

HubSign integrates with third-party services like HubSpot. You:

  • Are responsible for complying with third-party terms
  • Authorize HubSign to access your data within those services as needed

HubSign is not responsible for third-party services.

8. Privacy

Your use of HubSign is subject to our Privacy Policy, which explains how we collect and use your personal information.

9. Intellectual Property

HubSign owns:

  • The HubSign platform and software
  • Logos, branding, and trademarks
  • All related content and technology (except Your Content)

You may not copy, modify, or distribute HubSign without permission.

10. Disclaimers

HubSign is provided “as is.” We do not guarantee:

  • That our services will be error-free or uninterrupted
  • That documents signed through HubSign will be legally enforceable in every situation

Use HubSign at your own risk.

11. Limitation of Liability

To the fullest extent allowed by law, HubSign shall not be liable for:

  • Lost profits, lost data, or indirect damages
  • Damages exceeding the total fees you’ve paid to us in the past 12 months

Some jurisdictions do not allow these limits, so they may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless HubSign LLC, its affiliates, officers, directors, employees, contractors, licensors, and agents from and against any and all claims, demands, actions, damages, losses, costs, liabilities, expenses, or fees (including reasonable attorneys’ fees and court costs) arising from or related to:

  • Your use or misuse of HubSign services
  • Your Content, including documents you upload, send, or sign through HubSign
  • Your violation of these Terms
  • Your violation of any applicable laws or regulations
  • Your infringement or alleged infringement of third-party rights, including intellectual
    property, privacy, or data protection rights
  • Disputes between you and any third party, including signers or recipients of documents

Your obligations under this section:

  • Apply even if the claim arises after you stop using HubSign
  • Include the duty to fully cooperate with HubSign in defending any claim
  • Do not require HubSign to seek your approval before settling a claim, although we will
    notify you of significant developments

This indemnification survives the termination or expiration of these Terms and your use of
HubSign.

13. Changes to These Terms

We may update these Terms occasionally. Significant changes will be posted on our website or emailed to you. Continued use of HubSign means you accept the updated Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of Illinois. Any disputes shall be resolved in the courts of Chicago, Illinois.
